I just followed my steps above on a topic without nested replies.
As you can see below the modal the post has already been flagged for moderation by the user and clicking the flag modal again results in:
Looking at my site settings allow_all_users_to_flag_illegal_content might be what allows users to still flag as illegal after choosing another option.
