The TOS, like everything under /about uses the site locale, not the user locale.
As a site admin, you can replace the text in those seeded topics as described in Update seeded categories and topics.

But, according to @absi, he uses “spanish” as site locale language, and TOS still in English. 
The forum was either created at a time when there was no Spanish translation or it was initially created with an English locale. The “Replace” feature from the above link will sort this out.
