That would mean users won’t be able to create new topics if they have already spent all their votes too.

If your community has limited votes to cast, such as here on Meta, it makes sense for the OP’s vote not automatically be cast (see discussion here)

Rather than block creating topics, I could imagine the logic being that the topic is still created, but the vote is not auto-cast if there are no votes left.
